Terms of Service

Welcome to Nudge. These Terms of Service ("Terms") govern your access to and use of Nudge, an asynchronous turn-based multiplayer gaming platform (the "Service"). By accessing or using Nudge, you agree to these Terms.
1. Description of Service
Nudge lets users start and play turn-based games asynchronously with friends via shared links, without requiring a dedicated app store download. Nudge is provided as a Progressive Web App accessible on both Android and iOS.
2. Accounts
You may access Nudge by:
- Signing in with Google
- Creating an account with an email address and password
- Playing as a guest, with limited account features
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure
- Harass, abuse, or harm other users
- Use automated systems (bots, scrapers) to interact with the Service outside of normal gameplay
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Intellectual Property
The Nudge name, design, and underlying software are owned by us or our licensors. Individual games available on Nudge may reference publicly available game formats (e.g., trivia, pool, card games); no copyrighted or trademarked third-party content is knowingly reproduced without right to do so.
5. Virtual Tokens and Purchases
Nudge may sell virtual tokens for use on eligible in-app cosmetic items. Tokens have no cash value, cannot be transferred between accounts, and cannot be redeemed for money or anything outside the Service. A purchase is delivered only after Stripe confirms payment.
Refunds are provided where required by applicable law or when approved through our support process. A refund, reversed payment, or payment dispute removes the corresponding tokens. If those tokens have already been spent, the shortfall becomes a token balance owed on the account; paid cosmetic purchases remain unavailable until future token credits clear it.
Guest accounts cannot make token purchases. You are responsible for using a recoverable Google or email account and for reviewing the package and price shown by Stripe before confirming payment.
6. Advertising
Nudge may display advertisements, including through Google AdSense, to support the operation of the Service. See our Privacy Policy for details on how advertising cookies are used.
7. Beta Status and Availability
Nudge may currently be offered in a limited beta with features, availability, and access subject to change without notice. We do not guarantee uninterrupted access to the Service.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, Nudge and its operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause. You may stop using the Service and request account deletion at any time.
11. Changes to These Terms
We may revise these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
